1. Processing by OC IMP Klima
This Privacy Statement applies to the processing of data by OC IMP Klima d.o.o. (hereinafter: OC IMP Klima) and its subsidiaries. Responsibility for processing personal data lies with OC IMP Klima d.o.o., Godovič 150, 5275 Godovič, Slovenia.

2. Why do we process personal data?
To conduct its business activities, OC IMP Klima processes personal data. This is done in accordance with applicable legal obligations. We process your data for the following purposes:

  • handling your request for information or publications;
  • to offer and deliver the agreed services, products and/or information to you and to tailor these to your needs and wishes;
  • to send you a newsletter, offer, user information, service message or other electronic message;
  • recruitment of personnel and assessment of applicant suitability;
  • to comply with the laws and regulations that apply to us and to handle disputes and have (accountant) audits carried out;
  • to conduct market research and compile management information for the purpose of product and service development and for determining the (general) strategy;
  • compiling user statistics for our website;
  • security of our website.

If we wish to process personal data for a purpose unrelated to any of the purposes mentioned above, we will always inform you. This will be done by amending this Privacy Statement, posting a message on our website, or sending you a personal message.

3. What is the legal basis for processing personal data?

We may use your personal data because it is necessary for the execution of the agreement concluded with you to provide services or products, or because it is necessary to pursue our legitimate interest. This legitimate interest includes (digital) recruitment of personnel, promoting OC IMP Klima and its projects, connecting with (potential) clients and applicants, and improving our website. By entering your personal data in a web form, you also consent to the use of your personal data.

You can withdraw your consent to the use of your data at any time. We will then stop further use of your personal data, unless we have another legal basis.

4. Who can view your personal data?

Only OC IMP Klima employees who need your personal data to perform their duties have access to your data. Third parties will only be granted access to your data if we are certain that the third party will use it in a manner and for a purpose related to the purpose for which we obtained it. Furthermore, access will only be granted if this can be done in accordance with this Privacy Statement. We ensure that this third party has taken sufficient measures to protect your personal data. Syntess Software, the owner of our system, is a third party that has access to your data under the conditions stated above. Your data will not be transferred to a country outside the EU.

In some cases, we are legally obligated to provide data to third parties, such as the police. We always consider how we can respect your right to privacy as much as possible.

For the management and maintenance of our computer systems, it may also be necessary for our supplier to access the systems. This only occurs when strictly necessary. Access will, of course, be subject to strict conditions, including confidentiality, which we have agreed upon with the supplier.

If we wish to transfer your data outside Europe, for example because a data center or our supplier is located there, we will only do so under the conditions set by law, for example by means of a contract to which the “EU Model Clauses” apply.

5. Cookies and hyperlinks

Our website uses cookies. We do this to collect information about the pages users visit on our website, to track how often visitors return, and to see how often pages are visited. We also track what information the browser shares. Our websites contain hyperlinks to third-party websites. Orange Climate is not responsible for the content of these websites. Nor is OC IMP Klima responsible for the privacy policy and the use of cookies on these websites.

6. Your rights regarding the use of your personal data

You can object to the use of your personal data, for example, if you believe the use of your personal data is not necessary for the performance of our activities or to comply with a legal obligation. Other rights you have:

  • The right to access your personal data. Upon request, we will provide you with the information we have on file.
  • The right to rectification. If you believe we hold incorrect personal data about you, you can have it corrected.
  • The right to erasure. If you want us to erase your personal data, we will comply with your request. An exception to this is made only in cases where we have a compelling and/or legitimate interest in not deleting the data that outweighs your privacy interests. For technical reasons, it is not possible to delete the data from our backups. If a backup needs to be restored to the operational process, we will delete your data.
  • The right to transfer. You can ask us to transfer your personal data to another party.

You can exercise your right by sending a letter, including your name, address, telephone number, and a copy of a valid ID, to the (email) address listed in point 7, for the attention of the Data Protection Officer (DPO). We also request that you indicate in the letter that the processing concerns Orange Climate. Please be sure to redact your Citizen Service Number (BSN) on the copy before sending it. Clearly state in the letter which right you wish to exercise or which use of your data you object to. You will receive a response within one month.

We may not comply with your requests if they are unreasonably repetitive, require disproportionate technical effort, have disproportionate technical implications on our systems, jeopardize the privacy of others, or would be extremely impractical.

If you believe we are not handling your personal data properly, you can also file a complaint with our Data Protection Officer or the Dutch Data Protection Authority. Our Data Protection Officer's contact details can be found under point 7.

8. Retention periods

We do not store your data for longer than is necessary to carry out the activities described, unless we are required by law to store your data for a longer period.

9. How do we secure your data?

We take all reasonable and appropriate security measures to protect our website visitors, customers, and other data subjects from unauthorized access, alteration, disclosure, or destruction of personal data. We comply with applicable security standards.

If, despite our security measures, a security incident occurs that is likely to adversely affect your privacy, we will inform you as soon as possible. We will also inform you of the measures we have taken to mitigate the impact and prevent recurrence.
